Размере е-простора: има ли места за јавност? Критичка анализа предлога концепта политике о реформи е-простора и реформи просторног и урбанистичког планирања у РС

Abstract

Digitalizacija javnih dokumenata i procedura njihove formulacije, usvajanja i implementacije uz rastuću dostupnost (pokrivenost teritorije i cena) internet tehnologija i razvoj pristupačnih (hardver, jezik, znanje i cena) digitalnih alata mogu značajno da unaprede procese upravljanja razvojem društva. Digitalizaciju bi trebalo razumeti kao priliku za unapređenje transparentnosti,jednostavnosti, razumljivosti i pristupačnosti, odnosno kao dopunu i nadgradnju postojećih „analognih“ procesa i produkata. Ovaj rad se bavi kritičkom analizom sadržaja i procedure u kojoj je formulisan „Predlog koncepta politike o reformi e-Prostora: Koncepta politike o reformi prostornog i urbanističkog planiranja u Republici Srbiji“, budući krovni regulatorni dokument koji će omogućiti transformaciju sistema urbanističkog i prostornog planiranja - ključnog instrumenta upravljanja razvojem gradova. Predlog koncepta politike je 28. februara 2022. postavljen na uvid javnosti na sajtu Ministarstvo građevinarsta, saobraćaja i infratsrukture sa pozivom građanima i organizacijama da upute komentare i primedbe. Međutim, dokument je bez objašnjenja povučen sa sajta Ministarstva četiri dana pre isteka roka javnog uvida. Dokumentom se predlažu značajne promene sistema urbanističkog planiranja i iako u procesu njegove formulacije nisu organizovane tribine, radionice ili paneli, izazvao je veliko interesovanje i reakcije stručne javnosti. Uprkos tome što je Predlog koncepta politike povučen, smatramo da on reprezentuje stavove Ministarstva o načinu digitalizacije i transformacije sistema urbanističkog i prostornog planiranja, ali i ilustruje razumevanje i primenu konsultativnog procesa u izradi dokumenata javnih politika koji se predlogom zagovara, te da je stoga veoma važno preispitati i u javnosti prodiskutovati: (1) ključne postavke na kojima se dokument bazira, (2) ključna rešenja koja se dokumentom nude, posebno u domenu učešća javnosti, i (3) proces i procedure formulisanja predloga dokumenta.

Digitization of public documents and the procedures through which they are formulated, confirmed and implemented, together with the general availability (territorial coverage and price) of internet technologies and accessibility (hardware, language, knowledge and price) digital tools could make a great impact on processes that guide the development of society. Digitalization should be understood as an opportunity for improvement of the existing “analog” processes and products through increasing their transparency, simplicity, understandability and accessibility. This paper presents a critical analysis of the content and drafting procedure of “The draft policy concept on e-Space reform: Policy concept on spatial and urban planning reform in the Republic of Serbia”, an umbrella document that, if approved, would steer the transformation of the urban and spatial planning system - a key instrument for managing urban development. The Draft policy concept was made publicly available on February 28, 2022, through the Ministry of Construction, Transport and Infrastructure’s website, with an invitation to citizens and organizations to send their comments and remarks. However, four days prior to the specified public consultations deadline, the document was removed from the Ministry’s website. The document proposed significant changes to the urban planning system and, although no discussions, workshops or round tables were organized throughout the process of its formulation, its content provoked great interest and reactions from the professional public. Despite its withdrawal, we believe that the content of the Draft Policy Concept represents the Ministry's views on the manner of digitalization and transformation of urban and spatial planning systems, but also illustrates the Ministry’s understanding of the purpose and the scope of the participative processes in drafting public policy documents. It is therefore especially important to review and publicly discuss: 1) baseline ideas of the proposed reform, 2) key solutions offered by the document, especially in the field of public participation, and 3) the process and procedures of formulating the document proposal.
